DEFINITIONS:

RESERVATION or RENTAL: provision of services. 

SERVICES: seasonal rental of camping accommodation or pitches.

ACCOMMODATION: Tent, caravan, mobile home, chalet, cabatente, hut.

 

ARTICLE 1 - SCOPE OF APPLICATION

The present General Terms and Conditions of Sale apply, without restrictions or reservations, to any camping accommodation or pitch rental on the LA SOURCE campsite, operated by Socampres, to non-professional customers, on its website: www.camping-la-source.com or by telephone / 0565660562, mail: Camping la Source, Service Réservations, Presqu'île de Laussac, 12600 THERONDELS or e-mail, or when the Service Provider markets its Services. These do not apply to campsite rentals for mobile homes, which require a long-term rental contract.

The main features of the Services are set out on the website www.camping-la-source.com or in written form - paper or electronic - if the booking is not made online.

The Client is required to read them before finalising the booking. The choice and purchase of a Service is the sole responsibility of the Client.

These General Terms and Conditions of Sale apply to the exclusion of all other general terms and conditions of the Service Provider, namely those applicable to other marketing channels for the Services.

These General Terms and Conditions of Sale are accessible at any time on the website and shall prevail, if necessary, over any other version or any other contractual document. The version applicable to the Client is the one appearing on the website or communicated by the Provider at the time of the Client's Reservation.

In the absence of proof to the contrary, the data recorded in the Service Provider's computer system constitutes proof of all transactions concluded with the Customer.

The user is informed, in accordance with Article 27 of the French Data Protection Act of 6 January 1978, that the optional information that he/she communicates by answering the forms, if he/she so wishes, enables his/her request to be answered, and is intended for use by Camping La Source, which is responsible for processing it, for administrative and commercial management purposes and, unless he/she objects, by other companies in the group or by partner companies of Camping La Source. The user is informed that he/she has a right of access and rectification under the conditions defined by the Data Protection Act and the European Data Protection Regulation to all personal data concerning him/her by writing to Camping La Source at the following address

The Client declares that he/she has read these General Terms and Conditions of Sale and has accepted them either by ticking the box provided for this purpose before proceeding with the online reservation, as well as the general terms and conditions of use of the website www.camping-la-source.com or, if the reservation was not made on the internet, by any other appropriate means.

 

 

ARTICLE 2 - RESERVATIONS

The Customer selects on the website, or provides information on any document made available by the Provider, the services he/she wishes to book, according to the following terms and conditions:

The Client is responsible for checking the accuracy of the Booking and for reporting any errors to the Provider immediately. The Reservation will only be considered confirmed after the Provider has sent the Client a confirmation of acceptance of the Reservation by e-mail or by post or upon signing the contract if the Reservation is made directly at the premises where the Provider markets its Services.

Any reservation made on the website www.camping-la-source.com constitutes a contract concluded at a distance between the Client and the Provider.

All Reservations are personal and cannot be transferred under any circumstances.

Reservations:


The reservation of a stay implies the acceptance of our terms and conditions of sale as well as the campsite rules. The reservation request is nominative. It must be made by an adult who must be present during the entire stay. Minors without an adult are not admitted. The names,
names and ages of the participants must be communicated at the latest on the day of arrival. Any change to the reservation must be notified in writing.

Arrivals and departures:


In high season, arrivals and departures are possible on Saturdays and Wednesdays for a minimum of 7 nights' rental.
For camping pitches: Arrivals are possible from 2pm and departures must take place before 12 noon.


For accommodation rentals: Arrivals are from 4pm and departures before 10am.

It is imperative to check the inventory and report any anomaly within 48 hours after this deadline, no claim will be taken into consideration.


Deposit: For the accommodation, a rental deposit of 300€ and a cleaning deposit of 65€ will be requested separately at the latest on the day of your arrival. They will be returned to you on departure after the inventory of fixtures and fittings (after deduction of the costs of cleaning, replacements or repairs that may be necessary) or destroyed for departures without an inventory.

The appointment for the inventory of fixtures is optional. It can be arranged with the reception upon arrival.


 Any arrival not corresponding to the signed contract will be refused access to the campsite.

The reservation will be cancelled and the amount paid will be retained.
The campsite reserves the right to refuse access to groups or families arriving with a number of participants greater than the capacity of the pitch or accommodation reserved.

A baby counts as 1 person.
No arrivals without a reservation will be accepted after 7pm.


Late arrivals and early departures / No-shows at the campsite :


In case of late arrival or early departure, compared to the dates mentioned on your booking form, the total amount of the stay will remain due.


You will not be entitled to any refund for the part of the stay not completed.

In the event of a no-show on the site and in the absence of a message and/or proof, the rental will become available 24 hours after the date of arrival stipulated in the rental contract; full payment of the services is still required.

ARTICLE 3 - PRICES

The Services offered by the Provider are provided at the prices in force on the website www.camping-la-source.com or on any information medium provided by the Provider at the time of the reservation made by the Client. Prices are in Euros, with and without value added tax.

The prices take into account any discounts that may be granted by the Provider on the website www.camping-la-source.com or on any information or communication medium.

These prices are final and non-revisable during their period of validity, as stated on the website www.camping-la-source.com, in the email or in the written proposal sent to the Client. After this period of validity, the offer expires and the Provider is no longer bound by the prices.

They do not include the processing and management costs, which are invoiced separately, under the conditions set out on the website www.camping-la-source.comor in the information (mail, e-mail, etc.) communicated to the Client beforehand and calculated before the Booking is made.  

The Customer must pay the full price, including these costs.

An invoice shall be drawn up by the Seller and delivered to the Customer at the latest on the due date for payment of the balance.

3.1 Tourist tax :

The tourist tax, collected on behalf of the municipality/council, is not included in the prices. The amount is determined per person per day and varies according to the destination. This tax must be paid when paying for the Service and is shown separately on the invoice.

 

ARTICLE 4 - PAYMENT CONDITIONS

4.1. ADVANCE PAYMENT

At the time of booking, the Client must make an advance payment of 25% of the total price of the Services booked and provided. This must be paid on receipt of the final rental agreement and attached to the copy to be returned. This amount will be deducted from the total price of the booking.


For bookings made more than 30 days before the start of the holiday:


The reservation is only considered confirmed on receipt of the 25% deposit and the 19 € booking fee (non-refundable). A confirmation of reservation will be sent to you by e-mail (in case of request, the number of the pitch will be given only as an indication and may change).


Payment of the balance: The balance of the stay is to be paid, at the latest on the day of arrival, for the accommodations and the pitches.


For stays without reservation: Full payment must be made on the day of arrival.

 

 

 

 

 

 

Services and benefits included:


The booking of a stay gives access to the aquatic areas, to the free animations and to the children's clubs during the French school holidays in July and August. It includes the consumption of water and electricity (except for the nature category), as well as the necessary equipment for the number of persons according to the category of the reserved accommodation. One car can be parked per pitch on the pitch or nearby.

Free outdoor parking is available for additional vehicles.

For camping pitch bookings, a maximum of 6 people and 3 tents are allowed on the pitch.

4. PAYMENTS

PAYMENT TERMS - For bookings made more than 30 days before the start of the holiday, a deposit of 30% of the price of the services booked must be paid on booking (within 10 days). The balance must be paid at the latest 30 days before the start of the stay in the village. - For bookings made less than 30 days before the start of the stay, full payment must be made at the time of booking. - In the event of non-payment of the deposit at the time of booking (within 10 days) or of the balance at the latest 30 days before the start of the stay by the client, we reserve the right to cancel the booking and to offer the accommodation for rent again.

ARTICLE 5 - PROVISION OF SERVICES

5.1. PROVISION AND USE OF SERVICES

The camping accommodation or campsite can be occupied for pitches from 2 p.m. on the day of arrival and must be vacated by the customer by 12 noon on the day of departure, for rental accommodation from 4 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure

The balance of the stay must be paid in full by the day of arrival.

The accommodation and camping pitches are made available for rent for a given number of occupants and may not, under any circumstances, be occupied by a larger number of people.

The accommodation and pitches shall be left in the same state of cleanliness as on arrival. If the Client does not comply with this, an additional sum of €65 will be paid by the Client to cover the cost of cleaning. Any damage to the accommodation or its accessories will result in immediate repairs being made at the expense of the Client. The inventory at the end of the stay must be strictly identical to that at the beginning of the stay. 

5.2. SECURITY DEPOSIT

For accommodation rentals, the Client must pay a security deposit of €365 when the keys are handed over; this amount will be returned to the Client on the last day of the rental period, subject to a deduction to cover the cost of damages.

This deposit does not constitute a limitation of liability.

 

 

 

 

ARTICLE 6 - DELAY, INTERRUPTION OR CANCELLATION OF THE STAY BY THE CLIENT

No discount will be given for late arrivals, early departures or changes in the number of people (whether for part or all of the planned stay).

 

 

 

6.1. MODIFICATIONS

In the event of a change of dates or number of persons, the Provider will endeavour to accept requests for a change of date, subject to availability, without prejudice to any additional costs; in all cases, this is a mere obligation of means, as the Provider cannot guarantee the availability of a camping pitch or accommodation or of another date; in such cases, an additional sum may be requested

Any request to shorten the duration of a stay will be considered by the Provider as a partial cancellation, the consequences of which are governed by Article 6.3.

6.2. INTERRUPTION

Early departure does not entitle the Provider to any refund.

6.3. Cancellation of your stay without a Cancellation Guarantee

All cancellations must be made in writing (registered letter with acknowledgement of receipt or by e-mail) to the establishment. You will be asked to provide proof. Cancellation by the client will be invoiced according to the date of cancellation:

- Cancellation more than 60 days before the beginning of the stay : Refund of the deposit paid, minus the booking fee (15€) and any cancellation insurance (4% of the total amount of the stay, booking fee not included) Camping La Source, Presqu'île de Laussac, TEL : 0565660562

- Cancellation between 60 and 15 days before the beginning of the stay : The full amount of the deposit will be charged.

- Cancellation less than 15 days before the beginning of the stay: The full amount of the stay will be charged. You will always be offered a postponement of your stay, depending on availability. In case of refusal by the client, the above conditions will apply. So-called "comfort" reasons (e.g. weather) are not acceptable.

A complementary guarantee allowing you to obtain a refund of the amount of your stay in the event of cancellation under certain conditions, may be offered by the establishment.

6.4. Cancellation guarantee

This guarantee takes effect as soon as the rental contract is signed and expires at midnight on the day before the first day of your stay. Subject to the respect of the contractual obligations, this guarantee allows you to obtain the reimbursement of the sums paid (booking fees and subscription to the cancellation guarantee deducted), if your stay is cancelled in the following cases according to the exhaustive list below:

-        Serious illness, personal injury or death of :

· You, your legal or de facto spouse, your ascendants or descendants, your guardian

· Your brothers, sisters, brothers-in-law, sisters-in-law, sons-in-law, daughters-in-law, fathers-in-law, mothers-in-law Serious illness or serious bodily injury means any temporary or permanent impairment of your physical integrity, medically certified and involving the cessation of all professional or other activity.

-        Pregnancy complications

-        Serious damage requiring your presence on the day of your planned departure and resulting from theft, fire, water damage or natural elements affecting your main residence or your business premises which are more than 50% destroyed (certificate from the insurer to be provided).

-        Economic redundancy of yourself or your spouse, provided that the procedure was not initiated before the booking of the stay.

-        Refusal or modification of leave following a request from your employer.

-        Covid-19

Free cancellation and refund up to the day of arrival in the following cases:

· The client or a member of the group is positive or at Covid at the time of the start of the stay.

· Quarantine, following a positive test or declared a confirmed contact case, with the obligation to isolate and do the PCR test

· Hospitalization of the client or a family member (spouse or de facto spouse, ascendants or descendants, guardian) with COVID

· Requisition by the authorities in the fight against COVID

· The so-called "mass risk" reasons are excluded (general quarantine and confinement, state of health emergency, closure of borders, administrative closure of the establishment, refusal of access to the country of destination in case of absence of vaccination and in case the country of destination already imposed a vaccination at the time of booking the stay)

· All these reasons for cancellation must be communicated by registered letter accompanied by all the necessary documents establishing the facts (expert's report, police report, summons, medical or death certificate, employer's letter, etc.) as soon as they occur and at the latest within 3 working days following the accident or the event. So-called "comfort" reasons (e.g. meteorological reasons) are not admissible.

ARTICLE 7 - OBLIGATIONS OF THE CLIENT

7.1. PUBLIC LIABILITY INSURANCE

The Client on a pitch or in accommodation must have taken out a civil liability insurance policy.  A copy of the insurance policy may be requested from the Client before the start of the stay.

7.2. PETS

Pets are allowed under the responsibility of their owners. They are allowed subject to the conditions provided by the service provider and payable on arrival.

Pets are allowed on the campsite. They must be kept on a leash and be able to show their up-to-date vaccination certificate, proof of pupping or tattooing. You are responsible for picking up their droppings. Animals are not allowed in the sanitary facilities, on the multi-sports field, petanque field and children's club.

 - In accommodation, where they are accepted, only one dog per rental is allowed. They must not sleep in the bedding and must not cause any damage to property.

Animals must not be left ALONE in the accommodation. First and second category dogs are not allowed on the campsite.

- In open-air pitches or rentals, they are accepted with a supplement payable at the time of booking or on arrival.

7.3.  CAMPSITE RULES

The campsite rules are displayed at the entrance to the campsite and at the reception. The Client must take note of these rules and comply with them. They are available on request.

 

 

ARTICLE 8 - OBLIGATIONS OF THE PROVIDER - GUARANTEE

The Service Provider guarantees the Client, in accordance with the legal provisions and without additional payment, against any non-compliance or latent defect, resulting from a design or execution defect of the reserved Services.

In order to assert its rights, the Customer must inform the Service Provider in writing of the existence of the defects or lack of conformity within a maximum of 24 hours of the provision of the Services.

The Service Provider shall refund or rectify or cause to be rectified (to the extent possible) the services found to be defective as soon as possible, but no later than 15 days after the Service Provider has discovered the defect or fault. The refund will be made by credit to the Customer's bank account or by bank cheque to the Customer.

The Service Provider's liability is limited to the reimbursement of the Services actually paid by the Client. The Service Provider shall not be liable or responsible for any delay or non-performance resulting from the occurrence of a force majeure event as defined by French law.

The Services provided through the Provider's website www.camping-la-source.com comply with the French laws in force.

 

 

ARTICLE 9 - IMAGE RIGHTS

During your stay at our campsite, you may be photographed or filmed for the design and production of our advertising brochures, our website and various promotional media including Facebook. This authorisation is granted free of charge, for all countries and for a period of 5 years, unless you notify reception in writing on arrival that you object to this practice.

 

ARTICLE 10 - APPLICABLE LAW - LANGUAGE

The present General Terms and Conditions of Sale and the operations resulting from them are governed by and subject to French law.

The present General Terms and Conditions of Sale are originally written in French. In the event of translation into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.

 

ARTICLE 11 - DISPUTES

In accordance with the provisions of Article L 1612-1 of the Consumer Code, any customer of the campsite has the right to resort free of charge to a consumer mediator for the amicable resolution of a dispute with the campsite operator. ARTICLE 12 - PRE-CONTRACTUAL INFORMATION - CUSTOMER ACCEPTANCE

The Client acknowledges having received, prior to his Reservation, in a legible and comprehensible manner, the present General Terms and Conditions of Sale and all the information referred to in articles L 111-1 to L111-7 of the French Consumer Code, in addition to the details required in application of the decree of 22 October 2008 relating to the prior information of the consumer on the characteristics of the campsite rental accommodation, and in particular:

-        The essential characteristics of the Services, taking into account the communication medium used and the Services concerned;

-        The price of the Services and associated costs;

-        Information on the Provider's identity, address, telephone number, e-mail address and activities, if not apparent from the context;

-        Information on legal and contractual guarantees and their implementation; the functionalities of the digital content and, if applicable, its interoperability;

-        The possibility of resorting to conventional mediation in the event of a dispute ;

-        Information on termination and other important contractual conditions.

Any reservation by a natural person (or legal entity) on the website www.camping-la-source.com implies full and complete acceptance of these General Terms and Conditions of Sale, which are expressly recognised by the Client, who notably waives the right to rely on any contradictory document, which would be inapplicable against the Provider.

ARTICLE 15: EXCERPT FROM THE RULES OF PROCEDURE

The complete house rules are available at the reception.

Motorised traffic limited to 10km/h and prohibited between 11pm and 7am
- Silence is requested on the pitches from 11pm. Two warnings
for noise will result in expulsion. In case of numerous complaints or
violence, the expulsion will be immediate.
 - Individual charcoal barbecues are allowed on the pitch.
 - Guests without a stay must be declared. Their presence on the campsite is free of charge
under 2 hours. Vehicles must be left outside. In case of non-declaration of
guests, 3 times the current rate of 2 hours and more will be charged.
 - Showers and washbasins are closed between 23.00 and 7.00. The campsite reserves the right to
close a sanitary area in case of technical or maintenance problems.
 - Pitches must be kept clean, no rubbish or bottles may be left on them.
 Two warnings for a dirty pitch will result in expulsion. -
The number of occupants may not exceed the capacity provided for by the type of
accommodation. For the pitches : MAXIMUM 6 PEOPLE, at
least one adult, maximum 3 tents. -
No tent, vehicle or additional person is accepted without
the agreement of the campsite.
 - The Management cannot be held responsible in case of theft.

Water park :
Swimming trunks must be worn. Clothing, covering bathing suits and
swimming shorts are forbidden for reasons of hygiene and ARS regulations. The
swimming pool and the slide can be dangerous. It is
recommended to follow the
safety instructions. Young children or children who cannot swim must
remain under the supervision of their parents and must wear
swimming
 armbands.
It is compulsory for children wearing nappies to wear
nappies specially designed for swimming.
The campsite may have to close a slide or a pool from time to time in case of
bad weather, unforeseen technical problems or if there is a lack of
safety or hygiene. The rules posted in the aquatic area must be strictly
observed.
